Candidates may be required to sign and return a Liability and Publicity Release. Failure to sign may result in forfeiture of the fellowship and award of the fellowship to an alternate candidate.
Acceptance of the fellowship constitutes permission for Dow Jones to use the Fellow’s name and likeness for advertising and promotional purposes without additional compensation, unless prohibited by law. All candidates grant Dow Jones the right to use and publish their proper name and country and/or state of residence online, in print and any other media in connection with this program.
By entering, candidates release and hold harmless Dow Jones and their parent(s), subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with applying for or accepting the fellowship.
All candidates agree that (a) any claims, judgments and awards arising out of or in connection with the application process or any fellowship awarded shall be limited to actual out-of-pocket costs incurred, including costs associated with the application, but in no event attorneys’ fees; and (b) under no circumstances will any candidate be permitted to obtain any award for, and each candidate hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Guidelines, or the rights and obligations of any candidate and Dow Jones, shall be governed by, and construed in accordance with the laws of the state of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of New York, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than New York. The invalidity or unenforceability of any provision of these Guidelines shall not affect the invalidity or unenforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Guidelines shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
